Selectmen Minutes September 29, 2003
The weekly meeting of the Board of Selectmen was held on Monday evening, September 29, 2003 at 7:35 p.m.

Present: James M. Hardy, Chairman; Eric W. Greene, Clerk ; David L. Walsh

M/Greene, s/Walsh, move to approve the minutes of the September 22, 2003 meeting.
VOTE: Yes - Walsh, Hardy; Abstain: Greene; a majority vote in favor.

M/Greene, s/Walsh, a unanimous vote, move to accept, with regret, the resignation of Hugh F. Perrault as a member of the Finance Committee, effective immediately.

M/Greene, s/Walsh, a unanimous vote, move to approve the Application for a One-Day - wine & Malt License for Beaver Brook Beagle Club, 128 Belmont Street for October 10, 11 and 13 from 8:00 a.m. - 8:00 p.m. and Sunday, October 12 from 12:00 p.m. to 8:00 p.m.

M/Greene, s/Walsh, a unanimous vote as amended, move to accept the articles submitted for inclusion on the Special Town Meeting Warrant including a late article received from Atty. Robert Garrett for legal service performed during FY03, and to close the warrant for the Special Town Meeting to be held on Monday, October 20, 2003 at 7:00 p.m.

M/Greene, s/Walsh, a unanimous vote, move to approve the request of the Friends of Sachem Rock to place signs on the property to advertise the Fall Festival to be held on October 18, 2003.

It was noted that there is an opening on the Finance Committee; letters of interest may be submitted to the Selectmen's Office; deadline is October 10, 2003.

Letter regarding possible litigation relative to a town street - will be discussed in Executive Session.

Board members to respond with whether they can participate in the parade.

Invitation from Bridgewater Veterans to attend a dedication ceremony for a U.S. Postal
Service commemorative plaque honoring Korean War Veterans.

Invitation to attend a Forum on Assessments presented by Southeastern Regional School District on Thursday, November 6 at 7:00 p.m. in the school's Cinema 1.
Mr. Hardy and Mr. Greene will be attending. Request that this meeting be posted as two members of the Board will be present.

Invitation from Southeastern Regional Vocational-Technical School to attend the 23rd Annual Open House on October 18, 1:00 p.m. - 5:00 p.m.

Letter from Executive Department re: Chapter 90 funding; Town is apportioned $147,939 and program.

Letter from Dial-A-BAT re: Labor Negotiations

Board agreed to hold a Public Meeting on the Town Administrator Job Description on Tuesday, October 14.

Mr. Hardy gave a short report on the Joint Selectmen Association/MMA meeting and comments by guest speaker Rep. Barney Frank.

Mr. Hardy declared a 5-minute recess and will reconvene the Selectmen's Meeting at 8:00 p.m.
Recess at 7:54 p.m.

Appointment

A Public Meeting was held at the request of Forrest Emery, representing residents of Captain's Way relative to various concerns in respect to F1 Kart Raceway.

The following Boards/Committees were represented:
Planning Board - Roy Gardner, Chairman
Board of Health - Peter Spagone, Jr., Chairman; Robert Philbrick, Health Agent
Conservation Commission - Steven Sears, member; Susan Malloy, Administrator
Board of Assessors - Linda Libby and Curtis Gluck; Cheryl Pooler, Adm. Assessor
Chief of Police, John L. Silva
Fire Chief, Ryon Pratt
Town Moderator/Veterans' Agent, Peter Spagone, Sr.
Town Treasurer, Frank Savino
Town Counsel, John Stuebing
Counsel, Robert Kerwin
Finance Committee, Peter Hamilton
F1 Kart Raceway representatives, Atty. Ken Nabor; Michael Perrault

Also present were residents of Captains Way, Plain Street, Tardie Terrace and Northridge Drive.

Glenn Weiner, 21 Captains Way and Cheryl Jacques, 5 Captains Way acted as spokespersons for the neighbors. Other residents speaking were William Nolan, 17 Captains Way, Keith Lynch, 25 Captains Way, Christopher Ward, 30 Plain Street and several additional residents who did not give their names.

Mr. Gardner was allowed to speak first, as the Planning Board was short members this evening and another hearing was scheduled shortly. Mr. Gardner stated that there was a sound study planned for October 19 beginning between 8 and 9 a.m. and members of the Planning board would be observing the study. Stated that the sound study was part of the Special Permit requirements and that the hearing this evening for F1 had been continued until after the sound study report has been received.

The list of questions submitted by the residents is attached at the end of these minutes. Representatives of the various committees/boards, Police Chief, Fire Chief, and Treasurer answered whichever questions applied to their department. A videotape of the complete meeting is on file with the minutes.

Residents and department representatives left meeting at 11:15 p.m.

Open Forum
No one was present

M/Greene, s/Walsh, move to close Open Session and go into Executive Session for the purpose of discussing a pending litigation issue and will not be returning to Open Session.

Meeting adjourned at 11:17 p.m.
